Last updated 18 August 2026. These terms govern use of Fundio, operated by Wealth & Waste Management LLC ("Fundio", "we", "us"). By creating an account or sending a message through Fundio you agree to them.
Fundio is software for outbound sales teams. It sends and receives text messages, email and phone calls on your instruction, keeps a record of those conversations, and uses artificial intelligence to draft messages, answer replies and summarise calls.
Fundio is a tool. You decide who is contacted and what is said. We provide controls; we do not supervise your campaigns.
You must be a business, and the person accepting these terms must be authorised to bind it. Keep your login credentials secure. You are responsible for everything done under your account, including by your staff.
This section is the important one. By uploading a contact list or launching a campaign you represent that: you have a lawful basis to contact every person on it, and can evidence it on request; the people on it have not asked you to stop contacting them; you are not using Fundio to contact numbers on a Do Not Call registry where that is prohibited; and you will honour every opt-out, including ones made outside Fundio.
If you cannot evidence consent for a list, do not upload it.
You indemnify us against claims, fines and costs arising from messages you sent, lists you supplied, or consent you did not have. That includes claims under the Telephone Consumer Protection Act and equivalent state laws.
You may not use Fundio to send messages to anyone who has opted out; content that is unlawful, deceptive, harassing, or that impersonates another business; anything in a category carriers prohibit, including cannabis, illegal substances, firearms, high-risk financial offers such as payday lending, gambling, or sexually explicit material; or anything promising a loan approval, rate, payment or credit decision that has not been made.
We may refuse or stop any traffic that puts our carrier relationships or other customers at risk.
Some controls are not configurable, and asking for them to be removed is not a supported request. Any reply of STOP or an equivalent creates a permanent suppression for that recipient. Suppressed contacts are blocked before sending, not after. We block regions and number types we are not permitted to message. We keep a record of every opt-out indefinitely.
Fees are as shown on your plan and are billed for what you use. Usage-based charges, including per-message and per-minute fees, are billed in arrears. Fees are non-refundable except where the law requires otherwise. We will give 30 days notice of a price increase.
Third-party costs passed through to you, such as carrier fees and phone number rentals, may change without notice because they are not ours to control.
Numbers we allocate to you are leased, not sold. If your account closes, the number returns to us and may be reassigned. You are responsible for completing any carrier registration your traffic requires, and messages may be blocked by carriers until it is complete.
You own your contact lists and your conversation records. We process them to run the service and as described in our Privacy Policy. On termination you may export them for 30 days, after which we may delete them, except opt-out records, which we keep permanently.
We may use aggregated, de-identified information about how the platform performs to improve it. We do not use one customer's contacts or message content to serve another customer.
We aim for continuous service but do not guarantee it. Message delivery depends on carriers, providers and recipient handsets, none of which we control. We are not liable for undelivered or delayed messages.
Fundio generates messages automatically. Generated text can be wrong. You are responsible for what goes out under your name. Review your templates before launching, and check anything that states a fact about a rate, a product or a person's circumstances.
You may cancel at any time; charges already incurred remain payable. We may suspend or terminate an account that breaches these terms, that generates complaint or opt-out rates threatening our carrier standing, or that we are required to stop by a carrier or regulator. Where the risk allows, we will tell you first.
To the extent the law allows, Fundio is provided as is, and our total liability in any 12 month period is limited to the fees you paid us in that period. We are not liable for lost profits, lost business or indirect damages.
Nothing here limits liability for fraud or anything else that cannot lawfully be limited.
These terms are governed by the laws of the State of Florida. Disputes are subject to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida.
We may update these terms and will post the new version here. Continued use after a material change means you accept it.
